1. Heard Mr. Kaustubh Nande, on behalf of Mr. Arvind Sinha, learned counsel for the petitioner as well as Mr. Sourabh Sahu, P.L for the State. 2. By filing the present petition, the petitioners have prayed for following relief(s) :-
“It is therefore, prayed that this Hon'ble Court may kindly be pleased to allow the petition and direct to the
2 respondent to take an appropriate action on the written report made by the applicant with regard to theft of grocery item in his grocery shop in the interest of justice.”
3. The present petition has been filed alleging inaction on the part of the police authorities in taking action on the complaint submitted by the petitioner regarding an incident of theft. The case of the petitioner is that on the night of 05.09.2021, unknown persons allegedly broke open the lock of his house/shop situated at Village Kamarji, Police Station Kotadol, District Korea (Chhattisgarh), and committed theft of a wallet, utensils and grocery articles valued at approximately Rs.5,500/-. 4. Learned counsel for the petitioner submits that on 07.09.2021, the petitioner's brother, namely Krishna Mani Singh, submitted a written complaint before the Station House Officer, Police Station Kotadol, informing about the alleged theft and requesting investigation into the matter. Subsequently, upon receiving information from certain villagers regarding the possible involvement of some persons in the incident, a representation dated 30.09.2021 was submitted before the Superintendent of Police, Korea, mentioning the names of certain suspected persons and requesting appropriate action against them. 5. According to the petitioner, despite submission of the aforesaid complaints, no First Information Report was registered and no effective action was taken by the police authorities. Aggrieved by the alleged inaction of the respondents, the petitioner has approached this Court seeking a direction to the police authorities to take appropriate action on his complaint and investigate the alleged incident of theft in accordance with law. 3

Learned State Counsel submits that the alleged incident pertains to the year 2021 and the initial complaint was lodged against unknown persons. The subsequent representation made before the Superintendent of Police is based merely on suspicion and information allegedly received from villagers, without any cogent material connecting the named persons with the alleged theft. It is further submitted that the petitioner has an efficacious alternative remedy available under law before the competent Magistrate and has directly approached this Court without availing the same. In such circumstances, no case for issuance of a direction as prayed for is made out and the petition deserves to be dismissed. 7. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court finds that the initial complaint was lodged against unknown persons and the subsequent allegations against certain individuals are founded merely on suspicion and information allegedly received from villagers. No cogent material has been placed on record to establish the involvement of the named persons in the alleged offence. Furthermore, the petitioner has an efficacious alternative remedy available under law before the competent Magistrate for redressal of his grievance. In view of the aforesaid facts and circumstances, no case for exercise of extraordinary jurisdiction is made out. Accordingly, the petition being devoid of merit is hereby dismissed.
