The petitioners are apprehending their arrest in connection with Chhattarpur P.S. Case No.75/2026, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 117(2), 109(1), 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023, pending in the Court of the learned Judicial Magistrate, 1st Class, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioners submits that both the sides are agnates and there is land dispute between the parties and for that altercation took place. He further submits that so far as these petitioners are concerned, there are general and omnibus allegations against them. He next submits that the main allegation of assault is there against Sahmir Alam, Jahir Ansari, Samsul Ansari and Ashraf Ali @ Bablu. He also submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 13 of this application. 4. Learned counsel appearing for the State opposed the prayer and ( 2026:JHHC:24342 ) -2- A.B.A. No. 4513 of 2026 submits that the allegations of assault are there and in view of that, the prayer for anticipatory bail may kindly be rejected. 5. On perusal of the FIR, it transpires that there is direct allegation of assault against Sahmir Alam, Jahir Ansari, Samsul Ansari and Ashraf Ali @ Bablu. So far as these petitioners are concerned, there are general and omnibus allegations against them. It has been pointed out that due to land dispute the altercation took place and both the sides are agnates. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj in connection with Chhattarpur P.S.
