1. The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 67/2026, registered at Police Station Balod, District Balod (CG) for the offence punishable under Sections 296, 115(2), 109 and 3(5) of BNS.

The prosecution story in brief, is that the complainant Sagar Gupta resident of Sanjay Nagar on 31.12.2025, he was celebrating the New Year at home with his family The accused Moin khan, father sameer Khan Basir Khan, Sumit Kumar, and Avinash Sarthi came in front of the applicant's house and were abusing his mother and sister indecently. the complainant come out of the house and stopped the accused . the accused acting in collusion entered the house at night and abused the applicant and the witnesses indecently, threatened to kill them. And beat them with fists and steel rods causing injuries on the report, applicants He was arrested in the said case on the same date and produced before lerned trial Court and since then he is in judicial custody. Upon the Complainant Bittu Vishwas submitting a written complaint dated 07.12.2025 alleging that accused Murad and his accomplice (the present applicant) had stolen the complainant's mobile phone, stolen the PhonePe password, and defrauded him of a total of ₹67,300 through online PhonePe. On the same date, 07.12.2025, a case was registered against accused Murad and one other accomplice at Gandhinagar Police Station under Sections B.N.SL 303 (2), 318 (4) of the IPC and Section 66 (C) of the IT Act, and investigation was initiated. During the investigation, accused Murad Khan was arrested, and on the basis of his memorandum, applicant/accused Rubul alias Ravi Shankar was arrested. Hence, the bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submit that the dispute, if any, existed between other persons and the applicant was merely attempting to pacify and settle the matter. However, a false recovery has been shown from his possession and, due to political rivalry and enmity, he has been unnecessarily implicated in the present crime. He also submits that the injuries sustained by the complainant are simple in nature and do not support the prosecution's exaggerated version of the incident. The applicant is in jail since 08.02.2026 and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. She further submits that the applicant in collusion with two co-accused persons, abused and assaulted the injured persons and participated in the attack on Praveen, who sustained knife injuries on his abdomen and back, the injury sustained by the Praveen on his abdomen is found to be grievous in nature and is also dangerous to life, therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature &
4 gravity of the offence, material available in the case dairy and the fact that the material available on record prima facie reveals that the applicant, in furtherance of a common intention and in collusion with the co-accused persons, abused and assaulted the injured persons and actively participated in the incident wherein Praveen sustained knife injuries on his abdomen and back, the medical evidence further indicates that the injury inflicted on the abdomen of the injured, Praveen has been found to be grievous in nature and dangerous to life, as such, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant-Gulshan Kumar Sahu, involved in Crime No. 67/2026, registered at Police Station Balod, District Balod (CG) for the offence punishable under Sections 296, 115(2), 109 and 3(5) of BNS, is rejected. 8.
Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
