This is first bail application filed under Section 483 of BNSS, 2023 for releasing the applicant on regular bail in Crime No. 04/2025 registered at Police Station - Sargaon, District – Mungeli (C.G.) for the offence punishable under Sections 103(1), 109, 296, 115(2), 351(2), 3(5) of BNS, 2023 and Sections 25 & 27 of the Arms Act. 2. As per the prosecution’s case, it is alleged that on 13.01.2025, the applicant alongwith other accused namely Devnarayan Verma & Umesh Kumar Verma assaulted the deceased Karan Yadav and complainant Abhay Sahu by means of wooden stick, leather belt and knife, as a result of which, Karan Yadav died and Abhay Sahu ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.01.09 13:43:33 +0530
2 sustained injuries. Based on report filed by complainant injured Abhay Sahu, offence has been registered. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that injured eye-witness Abhay Sahu (PW-2) and other witnesses have been examined and they have turned hostile to the prosecution case. He next submits that the applicant is in jail since 15.01.2025, and there is no immediate possibility of conclusion of his case, , therefore, he may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the applicant along with other accused committed murder of one Karan Yadav and a knife was recovered from the present applicant and there is a named FIR against the applicant and co-accused. He further submits that the bail application of similarly placed co-accused Devnarayan Verma & Umesh Kumar Verma has been rejected by this Court by order dated 04.12.2025 passed in MCRC No.9575 of 2025, therefore, the bail of the present applicant is also liable to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly the material available on record, the nature of crime and further considering the fact that the bail application of co-accused has been rejected by this Court, I am not inclined to release the present applicant on bail. Accordingly, this bail application is rejected. 7.
However, considering the custody period of the applicant as he is stated to be in jail since 15.1.2025, the concerned trial Court is

directed to conclude the trial as early as possible preferably within a period 4 months from the date of receipt of a copy of this order.
