C.R.M. (NDPS) 332 of 2026
In Re: An application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Berhampore Police Station Case No.2181 of 2025 dated 12.10.2025 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985;
Mirjamal Sekh @ Mirjamal Sk. & Anr. Versus The State of West Bengal
Mr. Mrityunjoy Chatterjee Mrs. Suchismita Chakraborty Mr. Debarnab Adhikary. …for the petitioners.
Mr. Bibhashan Bhattacharya Mr. Sharequl Haque. …for the State.
Learned advocate appearing for the petitioners submits that because of non-submission of charge-sheet earlier the prayer for bail of the petitioners were rejected in CRM(NDPS) 166 of 2026, although one of the accused was granted bail exclusively on the ground that she happens to be a lady.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the quantum of seizure which is 21.56 kgs of ganja.
Having considered that charge-sheet has already been submitted and the quantum of seizure is just above the commercial quantity, I direct the learned trial court to release the petitioners on
2 bail on such terms and conditions as he deems fit and proper and after the consideration of charges are over.
With the aforesaid observations, CRM(NDPS) 332 of 2026 is disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
