JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.20/2024 pending before the Civil Judge and JMFC, Sullia, D.K District, for the offences under Sections 448, 354(A), 506, 509 of the IPC and Sections 66(E), 67, 67(A) of I.T Act. 2. Heard Sri.Lethif B, learned counsel appearing for the petitioner, Smt. Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Diveen Varma B, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:29336 CRL.P No. 2504 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the affidavit of the complainant. The said affidavit reads as follows: “"AFFIDAVIT I, Kairunnisa, W/o. Haneef, Aged About 27 Years, R/at: Bellanduru House, Belanduru Village, Kadaba Taluk, D.K. District- 574218, today at Bengaluru; do hereby solemnly affirm and state on oath as follows. 1. I state that, I am the complainant in the above case I know the facts and circumstances of the case. Hence I am deposing hereunder. 2. I state that, I have filed a complaint on a misconception of facts and without knowing the consequence and also suppression of fact by the accused. 3. I state that, my family members, parents and well wishers has advised me to settle the dispute amicably with intervention of both families, the petitioner/accused had agreed to settle the dispute and had advise me to withdraw the complaint. 4. I state that, we have settled the dispute amicably in order to give quietus to the dispute, I hereby undertakes to withdraw all the allegations against the petitioner/accused. 5. I state that, I have already married and have settled in my matrimonial life and in order to give quietus to the dispute and to lead peaceful harmonious life in - 4 - HC-KAR NC: 2026:KHC:29336 CRL.P No. 2504 of 2026 future I hereby withdraw the allegation against the petitioner. 6. I state that, the petitioner/accused has also married and having a daughter and even he has also settled in his life and residing with his family in the abroad. 7. I state that, I have fully satisfied with the above contents and I will not interfere with the petitioner or his family members in any way either directly or indirectly. 8. I state that, I have understood the contents of this affidavit, I have signed this affidavit with my own consent, without any force, threat or undue influence. Wherefore, I pray that, this Hon'ble Court may be pleased to permit the parties to compound the offence and consequently quash the entire proceedings in C.C No.20/2024 for the offence punishable under section 448, 354(A), 506, 509 of Indian Penal Code and 66(E), 67, 67(A) of I.T. Act, on the file of Civil Judge and JMFC, Sullia, D.K. District of Bellare Police Station, D.K. District; in the interests of justice.” 4. The complainant is present before the Court physically and petitioner is present through Video Conference and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the affidavit of the complainant and offences not being against the State, I deem it appropriate to accept the - 5 - HC-KAR NC: 2026:KHC:29336 CRL.P No. 2504 of 2026 compounding application and the affidavit of the complainant and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed.
