Present Writ Appeal has been filed for setting aside judgment and order dated 25.11.2025, passed in W.P.No.16826 of 2017.

Learned counsel for appellants submits that a number of issues have been raised in the writ petition, including the question of enhancement of Assignment Fee, Ground Rent, etc., vide G.O. dated 09.10.2013. However, the writ petition was dismissed as infructuous on the premise that lease period came to an end on 30.09.2018 and was never extended in favour of the writ petitioners, i.e., the present appellants. It is contended that issues so raised

are relevant and ought to have been adjudicated, as their non-consideration would have wider implications.

Learned counsel for respondents is unable to deny the same.
4. Keeping in view the facts and circumstances as noted above, judgment and order dated 25.11.2025, is set aside and the matter is remanded to the learned Single Judge to decide afresh. There is no expression of opinion on merits of matter as such.
5. Registry is directed to list W.P.No.16826 of 2017 before the appropriate Bench having Roster.
Writ Appeal is allowed accordingly. No costs. Pending miscellaneous applications, if any, in this case, shall stand closed.
