JUSTICE B M SHYAM PRASAD - 3 - HC-KAR NC: 2026:KHC:27001 WP No. 16613 of 2026 ORAL ORDER The petitioner is differently abled, and she is issued with a contract to oversee the running of a ‘public toilet’ on Lalbagh Fort Road, near KIMS Hospital, Bengaluru. The petitioner contends that though she was issued with the order in September 2020 to oversee the running of the ‘public toilet’, the electricity and water supply was ensured only in June 2022, and therefore, the contractual period is effectively reduced. The petitioner has filed different representations with the third respondent for extension of the contract with necessary extension of license. The petitioner contends that these representations have not been considered and that she is not informed about the decision on her representations. Sri Anandeeswar D R, the learned counsel for the petitioner, argues for directions to the third respondent to consider the representations and - 4 - HC-KAR NC: 2026:KHC:27001 WP No. 16613 of 2026 communicate the outcome of a reasoned decision. Sri Pawan Kumar, a learned standing counsel for the second and third respondent who is called upon to accept notice, is also heard. The third respondent must consider the petitioner’s request and decide on the possible extension before there are any further proceedings. This Court is of the considered view that the third respondent must consider all aspects including the factors relied upon by the petitioner and communicate a decision on her request for extension of the contractual period to run the ‘public toilet’ and that the third respondent must communicate such decision within a timeframe. Hence, the following: ORDER The petition stands disposed of reserving liberty to the petitioner to file a certified copy of this order with the third respondent within a week from the date of receipt thereof calling upon the third - 5 - HC-KAR NC: 2026:KHC:27001 WP No. 16613 of 2026 respondent to decide on the petitioner's application and communicate the decision to the petitioner in writing within four [4] weeks from the date of receipt of a certified copy of this order.
