This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 77/2026 registered at Police Station – Golbazar, District – Raipur (C.G.) for the offences punishable under Section 318(4) of the Bhartiya Nyaya Sanhita, 2023. 2. The prosecution story, in brief, is that the complainant, Dr. Nidhi Gwalre, Deputy Director (Nursing), Directorate of Health and Services, Chhattisgarh, Raipur, made a complaint to the Police Station Golbazar alleging that, as per the order dated 07.04.2026 issued by the Additional Secretary, Government of Chhattisgarh, Public Health and Family ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.06.23 10:37:28 +0530 2 Welfare Department, Mantralaya, Raipur (C.G.), it was found, inter alia, that Smt. Durgawati Usare (Kunjam), then Registrar, Chhattisgarh Nurses Registration Council, Raipur-cum-Principal, Government G.N.M. Training Centre, Kanker (C.G.), had proposed registrations on the basis of forged documents and had committed financial irregularities, thereby causing loss to the Government. It was further alleged that she had suppressed material facts and furnished misleading information contrary to the rules, acted for personal gain, and misused her position as a public servant for self-interest. Therefore, it was directed that a First Information Report be lodged against Smt. Durgawati Usare (Kunjam), then Registrar, Chhattisgarh Nurses Registration Council, Raipur-cum- Principal, Government G.N.M. Training Centre, Kanker (C.G.); Smt. Kajol Sahu, In-charge Principal, Mayaram School of Nursing, Ambagarh Chowki; Shri Basanta Kumar N., Principal, Surya College of Nursing, Janjgir-Champa (C.G.); Smt. Manju M.L., Vice Principal, Surya College of Nursing, Janjgir-Champa; Shri Mathew Fernandes, Human Resources II-Grade Casual Employee, Chhattisgarh Nurses Registration Council, Raipur; and the present applicant, Shri Narendra Kumar Dewangan, III- Grade Casual Employee, Chhattisgarh Nurses Registration Council, Raipur (C.G.). On the basis of the aforesaid order dated 07.04.2026, the Police Station Golbazar registered a First Information Report in connection with Crime No. 77/2025 against the aforesaid persons, including the present applicant, for the offence punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He argues that the First Information Report has been lodged by the complainant on the basis of the order dated 07.04.2026 issued by the Additional Secretary, 3 Government of Chhattisgarh, Public Health and Family Welfare Department, Raipur (C.G.). However, in the said order, there is no allegation whatsoever against the present applicant regarding the commission of any offence. He submits that while pursuing his nursing course, the present applicant was working on an honorarium basis as a Computer Operator under the orders of the Chairman-cum-Director and the Registrar, Chhattisgarh Nurses Registration Council, Raipur (C.G.). Therefore, he was duty-bound to discharge his duties in compliance with the directions issued by the Chairman-cum-Director and the Registrar, Chhattisgarh Nurses Registration Council, Raipur (C.G.). He also submits that as per the First Information Report, the alleged period of the incident is from 24.03.2022 to 23.04.2026. However, the applicant was not working during the said period as mentioned in the First Information Report. He also submits that the present applicant has no criminal antecedents except the present, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the bail application of the present applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, particularly the fact that no specific allegation has been levelled against the present applicant in the order dated 07.04.2026 issued by the Additional Secretary, Government of Chhattisgarh, Public Health and Family Welfare Department, Raipur (C.G.), and further considering the submission that the applicant was merely discharging his official duties as a Computer Operator under the directions of the competent authorities, that he was not working during the period of the alleged incident as mentioned in the 4 FIR, and that he has no criminal antecedents, this Court, without further expressing any opinion on the merits of the case, is inclined to grant anticipatory bail to the present applicant. 7. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Narendra Dewangan, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
