JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question proceedings in proceedings in C.C.No.32717/2022, pending before the XLI ACJM, Bengaluru, registered for the offences punishable under Sections 498(A), 323, 326, 504, 506, 354(A)(4) read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. - 3 - HC-KAR NC: 2026:KHC:29324 CRL.P No. 8359 of 2026 2. Heard Sri.V.F.Kumbar., learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.6153/2023 C/w M.C.No.5499/2023 and have settled the dispute amongst themselves before the Family Court by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The Memorandum of Settlement reads as follows: "MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATION) RULES, 2005. I. The Petitioner has filed this petition against the Respondent under Section 13 (1) (i-a) (ib) of the Hindu Marriage Act, 1955 for dissolution of his marriage with the respondent/wife and the respondent earlier had filed a petition Under Section 9 of Hindu Marriage Act in M.C.No. 5499/2023 seeking restitution Conjugal rights. II. The aforesaid petition was referred to mediation for resolving the dispute between the parties. During the course of Mediation the parties along with their respective advocates have participated and resolved - 4 - HC-KAR NC: 2026:KHC:29324 CRL.P No. 8359 of 2026 their dispute and agreed to the following terms and conditions: 1. The petitioner and the respondent state that their marriage was solemnized on 24.08.2020 at S.J.P. Kalyana Matapa, Vibhuthipura, Marathahalli Post, Bangalore- 560037 as per Hindu rites and customs. 2. That the parties due to irreconcilable differences between them and incompatibility and temperaments have been living separately since 25.09.2021. The efforts made by the elders, friends and well wishers to resolve the differences between the parties did not yield any fruits. There is absolutely no chance of a reunion between them. The petitioner and the respondent know that their marriage is irretrievably broken down and there are no chances of reunion to lead a happy married life. Hence, the petitioner and the respondent have decided to get the marriage dissolved by a decree of divorce. 3. The parties state that they have no children born form this wedlock. 4. The petitioner has agreed to pay a sum of Rs.80,00,000/- (Rupees Eighty Lakhs only) to the respondent towards the maintenance/permanent alimony as full and final settlement of all her claims by way of demand draft bearing No.229585 dated 08.05.2026 drawn on State Bank of India, Victoria Road Branch, Bengaluru and same will be handed over to the respondent by the petitioner at the time of reporting the settlement before the Hon'ble Court. The respondent has agreed for the same. - 5 - HC-KAR NC: 2026:KHC:29324 CRL.P No. 8359 of 2026 5. The respondent has agreed to withdraw her petition in Crl. Mis.No.106/2022 filed before JMFC-(TC-III). 6. The respondent further, agrees to withdraw Criminal Appeal No.418/2026, 419/2026, 422/2026, 423/2026, 424/2026 pending on the file of Additional City Civil and Sessions Judge at Bengaluru (CCH-65) against the petitioner and his family members challenging the interim orders. 7. In addition the following cases will also be withdrawn by the respondent: a) C.C.No.32717/2022 Pending before 41st ACJM, Bangalore. b) C.C.No.37682/2025 against petitioner and his father pending before 48th ACJM, Bangalore. The Respondent - Supriya S.M., undertakes to co-operate for closure/quashing of the above cases pending before respective Hon'ble courts. c) To give consent for Closure of criminal Petition No.5750/2022 and Criminal Petition No.10054/2022 and No.6867/2026 filed by the petitioner and his family members. d) Crl.Misc.No.6470/2025 pending before Additional City Civil and Sessions Judge at Bengaluru in CCH-46 Seeking Cancellation of Bail against J.Sukumar (father of petitioner). 8. Both the parties state that they have no claims over the movable or immovable properties either existing at present or to be - 6 - HC-KAR NC: 2026:KHC:29324 CRL.P No. 8359 of 2026 acquired in future including any kind of articles. 9. The respondent agrees to give consent for quashing compounding off the offence pending before all the Trial Courts in High Courts of Karnataka and shall co-operate and ensure that, the petition filed by them are quashed in toto. 10. Both the parties state that they have already exchanged their valuable articles and other personal belongings. 11. Both the parties undertake to withdraw all the allegations made against each other at all trial courts of the high court as cited above. 12. Both the parties herein state that there is no undue influence, force, or coercion in entering into this agreement from any one or anything. 13. Both the parties admit that they shall not interfere in the personal lives of each other in future. III. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 24.08.2020 at S.J.P. Kalyana Matapa, Vibhuthipura, Marathahalli Post, Bangalore-560037 by granting a decree of divorce in terms of this agreement. IV. Therefore, in light of the settlement arrived at between the parties quoted supra and the offences not being against the State, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii.
