Learned Senior counsel for the petitioner submits that the petitioner is in custody since 11.06.2025 in connection with S.T Case No. 53/2026 arising out of Balumath P.S. Case no. 54 of 2025 corresponding to G.R Case No. 840 of 2025, registered for the offence punishable under sections 103(1), 238(b) and 61(2) of B.N.S. 2023, now pending in the court of learned Additional Sessions Judge-III, Latehar. 3. Learned Senior counsel for the petitioner further submits that the bail application of the petitioner was rejected earlier on 19.02.2026 in B.A. No. 11425 of 2025 on the ground that on the basis of confessional statement of the petitioner, the mobile of the deceased has been recovered from bushes. The learned Senior counsel submits that there is a mismatch with respect to the time of registering the First Information Report and the seizure list and it appears that seizure was made prior to lodging of the FIR. He submits that on this ground the petitioner be released on bail. The learned senior counsel has referred to the seizure list at page no. 17 of the bail application which also contains the signature of the police officer and independent witnesses. 4. Learned counsel for the opposite party - State has opposed the prayer for bail and has submitted that the bail application of the petitioner has been rejected earlier on merits. 2026:JHHC:24944 2 5. After hearing the learned counsels for the parties, this court finds that the bail application of the petitioner was earlier rejected on 19.02.2026 in B.A. No. 11425 of 2025 after considering the submissions made by the learned counsels for the parties who were then appearing and the submissions made by the learned Senior counsel for the petitioner are matters of trial. Material witnesses are yet to be examined before the trial court. In such circumstances, this court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected at this stage. 6. Let a copy of this order be communicated to the learned court concerned through “FAX/email”. (Anubha Rawat Choudhary, J.) Date of Order:19.08.2026 Pankaj Date of Uploading:20.08.2026
