JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in Crime No.141/2026 pending before the ACJM, Bengaluru Rural District, Bengaluru, for the offences punishable under Sections 85, 88 read with Section 3(5) of BNS, 2023. 2. Heard Sri.M.R.Nanjunda Gowda, learned counsel appearing for the petitioners, Smt.Waheeda M.M., learned HCGP appearing for respondent No.1, Sri.Harish Shiralakoppa, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: - 4 - HC-KAR NC: 2026:KHC:29325 CRL.P No. 8388 of 2026 "JOINT AFFIDAVIT We, 1) Bharath G.K, Aged about 26 years, S/o.Gajendra, R/a.No.10, 1st left, Prajavani Layout, Devasandra, Krishnarajapuram, Bengaluru North, Bengaluru - 560 036, 2) Gajendra K.N, S/o.Nanjappa, Aged about 46 years, R/o, No.78/2, Gajendra Building, Masjid Road, Rajeev Nagar, Devasandra, K.R Puram, Bengaluru 560 036, 3) Smt.Jayanthi, W/o.Gajendra, Aged about 42 years, R/o, No.234, 5th Main, 1st Cross, Devasandra, Krishnarajapuram, Bengaluru 560 036, 4) T.N Preethi, C/o. Bharath G.K, Aged about 23 years, R/a, No-2, Samruddi Layout, 560 049, do herby Kitaganur village, Bidarahalli Hobli, Bengaluru solemnly state on oath as follows; 1. I, T.N Preethi, Deponent No.4 had initiated a complaint against my husband Bharath G.K, and my in-laws i.e., Gajendra K.N and Jayanthi who are Deponents No. 2 to 4 for the offences punishable under Section 85, 88 r/w 3(5) of BNS of Avalahally Police now pending on the file of the Additional Chief Judicial Magistrate (ACJM), Bengaluru rural district. 2. We submit that owing to certain misunderstandings and matrimonial differences that arose between us, Deponent No.4 had lodged the complaint which resulted in registration of the impugned crime. The complaint came to be lodged during a period of strained relations and on account of the advice and intervention of certain persons who were not well-wishers of either family. 3. We further submit that subsequent to the registration of the case, elders, family members, parents and well- wishers of both families intervened and facilitated discussions between us. Upon such intervention, all misunderstandings and differences were amicably resolved. 4. We submit that we have realized that the dispute arose primarily on account of miscommunication, misunderstandings and the influence of third parties. We have now decided to put an end to all past disputes and continue our marital relationship peacefully. 5. We Deponent No.1 & 4 further submit that since the second week of April 2026, we have resumed cohabitation - 5 - HC-KAR NC: 2026:KHC:29325 CRL.P No. 8388 of 2026 and are residing together as husband and wife. We are leading a happy and peaceful matrimonial life and there are no subsisting disputes between us. 6. We state that the present settlement has been arrived at voluntarily, out of our own free will and volition, without any force, coercion, undue influence or pressure from any person whatsoever. 7. I Deponent No.2 submit that, in view of the amicable settlement and restoration of cordial relations between us, I have no objection whatsoever for allowing the present petition and for quashing the impugned crime. We are of the considered view that continuation of the criminal proceedings would serve no useful purpose and would only disturb the peace and harmony restored between us. 8. We submit that, in view of the amicable settlement, continuation of the criminal proceedings would serve no purpose and would only result in abuse of the process of law. 9. We the deponents jointly pray that this Hon'ble Court may be pleased to record the settlement, compound the offences, and quash Crime No.141/2026, of Avalahally Police Station for the offences punishable under Sections 85, 88 r/w 3(5) of BNS, in the interest of justice and equity. WHEREFORE, we pray that this Hon'ble court be pleased to allow the accompanying application in the interest of justice. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.141/2026 pending before the Addl.
