By the present writ petition the petitioner seeks direction upon the respondent authorities, particularly respondent no.5, the District Inspector of Schools (SE), Coochbehar to grant transfer in favour of the petitioner to any of the schools preferred by the petitioner. 2. The petitioner contends that she joined as an Assistant Teacher in Bhuskadanga Bholanath High School on 19th September, 2008. The service of the petitioner has been duly approved by the concerned authority on 27th November, 2008. Subsequent thereto, the petitioner was mutually transferred to Hazrahat Harish Chandra High School vide order dated 4th 2 August, 2012, where the petitioner joined on 11th August, 2012. The service of the petitioner has been approved by the concerned authority on 6th September, 2012. The petitioner is suffering from serious gynaecological disorder coupled with numerous intramural and sub serosal fibroids in the uterus and for which the petitioner is undergoing regular treatment and medication. On 14th January, 2026 the petitioner made an application before the school authorities seeking her transfer. On 21st January, 2026 the application of the petitioner seeking transfer has been forwarded to the respondent no.5, the District Inspector of Schools (SE), Coochbehar. However, no steps have been taken as yet. Hence, this writ petition. 3. Mr. Shuvro Prokash Lahiri, learned Advocate for the petitioner submits that the District Inspector of Schools (SE), Coochbehar, respondent no.5 be directed to consider the application of the petitioner seeking transfer and forward the same to the West Bengal Central School Service Commission for further consequential action. 4. Mr. Sunit Kumar Roy, learned Advocate for the West Bengal Central School Service Commission appearing through virtual mode submits that the District Inspector of Schools (SE), Coochbehar has to consider the application of the petitioner 3 upon medical examination of the petitioner by CMOH of the concerned district in relation to her prayer for transfer on medical ground and on being satisfied the same has to be forwarded to the West Bengal Central School Service Commission for further action. 5. Mr. Samar Rakshit, learned Advocate appearing on behalf of the State leaves the matter to the discretion of this Court. 6. It is found from the letter of the Headmaster of Hazrahat Harish Chandra High School (H.S.) dated 21st January, 2026 at page 108 of the writ petition that the application of the petitioner seeking transfer has been forwarded to the District Inspector of Schools (SE), Coochbehar. There cannot be any dispute that the application of the petitioner seeking transfer on medical ground is pending at the end of the District Inspector of Schools (SE), Coochbehar, respondent no.5. 7. Accordingly, upon consideration of the submissions advanced on behalf of the respective parties, the respondent no.5, District Inspector of Schools (SE), Coochbehar is directed to consider the application of the petitioner and if it is found that the petitioner is eligible, the same shall be forwarded to the West Bengal Central School Service Commission along with medical 4 report for further consequential steps, in accordance with law, within a period of six weeks from the date of communication of this order. On receipt thereof, the West Bengal Central School Service Commission shall consider the same within a period of four weeks. 8. With the above direction, the writ petition being WPA 685 of 2026 stands disposed of. 9. Petitioner is directed to communicate this order to the District Inspector Schools (SE), Jalpaiguri, respondent no.5 for necessary compliance. 10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15.
