ICICI Lombard General Insurance Company Ltd. vs. Reshma Devi and others CMP Nos.21388 & 21389 of 2026 in FAO No.92 of 2018 11.09.2026 Present: Ms. Diksha, Advocate, vice Mr. Jagdish Thakur, Advocate, for the appellant/non-applicant. Mr. Vinod Kumar, Advocate, vice Mr. Nimish Gupta, Advocate, for applicants in CMP Nos.21388 & 21389 of 2026. CMP No.21388 of 2026 The present application has been filed by respondent No.2-applicant (Sahil Kumar), seeking discharge of his natural guardian, as the applicant has attained the age of majority. From a perusal of the application, it is evident that the applicant-Sahil Kumar had been arrayed as a party on account of death of his father. At the said point of time, his interests were protected by his natural guardian/mother, one Smt. Reshma Devi. Aadhaar Card of applicant-Sahil Kumar has also been annexed along-with the application (Page-77 of the paper book). The same reflects the date of birth of the applicant as 21.08.2006. In view thereof, it is evident that the applicant has attained the age of majority and, hence, his natural guardian- Smt. Reshma Devi (mother), is discharged from pursuing the present proceedings on behalf of the applicant. The applicant is free to participate in the present proceedings of his own. Power of attorney on behalf of the applicant stands filed and he is duly represented by his counsel. In view thereof, present application is allowed and disposed of accordingly. CMP No.21389 of 2026 No reply is intended to be filed on behalf of the non- applicants. The non-applicants have no objection, if in case the present application is allowed and the amount lying deposited in the Registry of this Court, is ordered to be released in favour of the applicant, i.e., respondent No.2. The appeal, in the case at hand, was decided on 21.07.2023. However, from the modified award, it is evident that no amount had been awarded in favour of respondent No.6, hence, present application on her behalf is not maintainable. In view of the aforesaid and for the reasons stated in the application, the same is allowed. The amount lying deposited in the Registry of this Court along with proportionate interest accrued thereupon, is ordered to be released in favour of applicant-Sahil Kumar, as per his share, by remitting the same in his bank account, details whereof, have been furnished in Paragraphs-5 of the application, subject to proper verification. The application stands disposed of. ( Bipin C. Negi ) September 11, 2026 (KS) Judge
