The applicant has preferred this 2nd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No.286/2025, registered at Police Station – Saragaon, District- Janjgir-Champa (C.G.) for offence punishable under Sections 103(1), 238, 3(5) of BNS. 2. First bail of the applicant was dismissed as withdrawn vide order dated 02.02.2026 passed in MCRC no.762/2026. 3. In this case there are total 3 accused persons. The prosecution's case, in short, is that it is revealed that on the morning of 22.10.2025, the dead body of deceased Manish Kumar Mithlesh was found under the SHUBHAM SINGH RAGHUVANSHI Digitally signed by SHUBHAM SINGH RAGHUVANSHI Date: 2026.06.23 11:15:00 +0530 2 Karanga and Chataud bridge, regarding which Chowki Birejhar registered a Merg and got the postmortem conducted. As the nature of death of the deceased was found to be homicidal, an offence was registered against unknown accused. During investigation, it was found that on the night of 21.10.2025, accused Homesh Kumar and Chahat Yadav took the deceased to the spot on his motorcycle, assaulted him, and threw him under the bridge. Thereafter, accused Homesh Kumar Sahu went under the bridge and murdered Manish Kumar Mithlesh by hitting him multiple times on the head and face with stones. On the night of the incident, Homesh Kumar Sahu handed over the clothes he was wearing and the deceased’s mobile phone to the applicant/accused Manish Kumar Sahu to destroy/burn them. The applicant burned the clothes in front of the house and the mobile phone at the riverbank of village Ravan. The half-burnt mobile phone was seized from the place disclosed by the applicant. Based on above, offence has been registered against the applicant and he was arrested on 27.10.2025. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The main accused is Homesh who murdered the deceased. The only allegation levelled against the applicant is that he had burnt clothes and mobile of the deceased. He further submits that he has withdrawn first bail application filed before this Court on 02.02.2026 and on 02.02.2026 itself, charge under Section 238(1) of BNS has been framed against the applicant which is bailable in nature. The applicant is in jail since 27.10.2025, out of 19 prosecution witnesses only 11 have been examined till date and the trial is likely to take time to be finalized, therefore, it is prayed that the applicant may be enlarged on bail. 5. Per contra, learned Counsel appearing on behalf of the State opposes the bail application. 6. I have heard learned Counsel appearing for the parties and perused the material available on record. 7. Considering the facts and circumstances of the case, evidence collected by the prosecution, detention period of the applicant and the 3 fact that charge has been framed against the applicant under Section 238 (1) of BNS. Further considering that the trial is likely to take some time to be finalized, without further commenting on merits of the case, I am inclined to release the applicant on bail. 8. Accordingly, the bail application is Allowed. 9. It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- with one solvent surety for the like sum to the satisfaction of the Trial Court for his appearance before the said Court as and when directed.
