CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 29.06.2026
02. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Anantapur P.S. Case No.82 of 2026 corresponding to C.T. Case No.694 of 2026 pending in the file of learned J.M.F.C., Soro on the grounds stated therein. 3. Perused the FIR as at Annexure-1. The objection filed by the informant is gone through. The photographs showing the injuries received by the victim have been produced along with the medical prescriptions and the same are taken on record. In fact, Mr. Das, learned counsel and his associates enters appearance for the informant today filing the Vakalatnama and the same is also taken on record. Mr. Das, learned counsel would submit that the victim has received injuries in the hand
and on the head referring to the coloured photographs produced today. Mr. Sahu, learned counsel for the petitioners, on the other hand, submits that the injuries are not grievous and it has been at the instance of petitioner No.2. Recorded the objection of the State, according to whom, the assault was by means of an axe. On a reading of the FIR, it is made to understand that petitioner No.2 is the assailant, whereas, petitioner No.1 and 3 are the parents-in-law of the informant. The victim is the husband of the informant, who has been assaulted. But, considering the assault by petitioner No.2, this Court is not inclined to entertain his bail plea further recording the submission of Mr. Das, learned counsel that he has two other antecedents. But, in so far as petitioner Nos.1 and 3 are concerned, considering the nature of dispute in the family, this Court is in favour of directing their release upon surrender before the learned court below even though their bail plea is not entertained. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL vis-à-vis petitioner No.2 stands rejected, however, granting him the liberty to surrender before the learned court below seeking regular bail.
As to petitioner Nos.1 and 3, it is directed that on their surrender before the learned J.M.F.C., Soro in connection with Anantapur P.S. Case No.82 of 2026 corresponding to C.T. Case No.694 of 2026 within a fortnight from today, they shall be released on bail on furnishing bail bonds of Rs.20,000/-(twenty thousand only) each with one solvent surety each for the like amount and
such other terms and conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, none shall involve themselves in further mischief with the informant and her family in any manner and whatsoever and to furnish an undertaking to that behalf at the local PS. 6. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Sumitra
