1. This is an office reference.
2. This Court, vide order dated 24.11.2023 passed in MCRC No. 6704 of 2023, while allowing the bail to the petitioner, namely, Vaasu Sahu had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certified copy of the order, if there was no legal impediment.
3. Earlier on five occasions also this Court had granted extension of time for compliance of the order dated 24.11.2023.
4. The learned Special Judge (NDPS Act), Bilaspur District-Bilaspur (C.G.) vide his request letter dated 04.06.2026 has requested for grant of KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 two month’s additional time for concluding the trial.
5. It transpires from perusal of the P.U.D. that the evidence of the Investigating Officer and one other prosecution witness still remains to be recorded. The record further reveals that summons and bailable warrants have been issued for securing the presence of the prosecution witnesses, however, the witnesses have failed to appear before the concerned Court on the dates fixed. It is further revealed that summons and bailable warrants are being issued through the Nodal Officer, Deputy Superintendent of Police (Headquarters), and the Superintendent of Police, Bilaspur, for securing their presence. The P.U.D. further reflects that the witnesses are not appearing before the concerned trial Court despite such efforts. It is also submitted that a considerable number of NDPS cases, including time-bound matters, as well as other civil and criminal cases are pending before the learned trial Court and continuous efforts are being made for their expeditious disposal. In the aforesaid circumstances, he sought extension of time and has prayed for grant of a further period of two months for concluding the trial and final disposal of the case.
6. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of two months from the date of receipt of a certified copy of this order.
7. Accordingly, this CRMP stands disposed off with the aforesaid direction.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
