APP Mr. Sankalpa Bhattacharjee ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the parents in law of the alleged victim. The marriage took place about four months before the incident. The alleged victim committed suicide at her own paternal home. The petitioners are not the principal accused. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He refers to the post-mortem report and the statements of the father of the victim as well as the other independent witnesses like neighbours of the accused. The other independent witnesses have also implicated the present petitioners, especially the father in law. According to the victim’s father, the accused did not let the lady live in peace even at her own home. The husband and the father in law used to call up and threaten. It was on the next date of one such incident that the victim committed suicide. 2 Considering the above, the other materials available in the case diary and the roles ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner no.1, the application for anticipatory bail of the petitioner no. 2 is rejected. In the event of arrest, the petitioner no.1 (Moslema Bibi) shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner no.1 (Moslema Bibi) shall co-operate with the investigation and shall not threaten or intimidate the witnesses. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
