Harsha Kumar Gowda.H.R, learned counsel appearing for the respondent No.4. 2. In this writ petition, petitioner is assailing the order dated 28.06.2024 (Annexure-K), passed by the respondent No.1. 3. Having taken note of the submissions made by the learned counsel appearing for the parties, the petitioner herein has filed R.A.(N) No.58/2019 before the respondent No.2, challenging the mutation in MR No.4/1992-93. The respondent No.2 by order dated 04.01.2021 remanded the matter to the respondent No.3. Feeling aggrieved by the same, the respondent No.4 has preferred RP No.1/2023 and the respondent No.1 - - 4 - HC-KAR NC: 2026:KHC:29163 WP No. 21525 of 2024 Deputy Commissioner, by order dated 28.06.2024 remanded the matter to respondent No.2 - Assistant Commissioner. 4. In that view of the matter, I find force in the submission made by the learned counsel for the petitioner that the respondent No.1 - Deputy Commissioner, ought to have remanded the matter to respondent No.3 - Tahsildar, instead of the respondent No.2 - Assistant Commissioner. The non application of mind by the respondent No.1 is forthcoming from the impugned order. In that view of the matter, I pass the following; ORDER (i) The writ petition is allowed. (ii) The order dated 28.06.2024 (Annexure-K) passed in RP No.1/2023 is accordingly quashed and the matter is remanded to respondent No.3 - Tahsildar to reconsider the issue afresh after affording an opportunity of hearing to both the - 5 - HC-KAR NC: 2026:KHC:29163 WP No. 21525 of 2024 parties and take decision in the matter in accordance with law, within a period of four months from the date of receipt of certified copy of this order. (iii) Since the parties are represented through their learned counsel, parties are directed to appear before the respondent No.3 - Tahsildar on 15.07.2026 at 03.00 p.m. and after their appearance respondent No.3 shall dispose of the matter as stated above.
