ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 118(1), 296(b), 351(3) of BNS Act and Section 4 of TNPWH Act, in Crime No.3 of 2026, on the file of the 1/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.4770 of 2026 respondent police, seeks anticipatory bail. 2.The case of the prosecution is that due to previous enmity, on 02.01.2026 at 12.00 hours, the petitioner along with other accused said to have attacked with iron rod on the head of the defacto complainant. Hence, the above has been registered as against the petitioner for the above alleged offence. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he is not involved in any occurrence as alleged in the FIR. He has falsely implicated in the case. There is case in counter case has been registered. The injured also discharged from the hospital. He seeks this Court to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. side) appearing for the respondent on instructions submitted that there is no previous case pending against the petitioner and there is serious allegation made against the petitioner. There is case in counter has also been registered and the injured was discharged from the hospital. Hence, he sought dismissal of the petition. 2/5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD)No.4770 of 2026 5.Considering the dispute between the parties, there is a case in counter case and also considering that the injured in this case has been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate No.V, Tirunelveli, within a period of fifteen days from the date on which the order made ready and on further conditions that: [a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of fifteen days and thereafter, as and when required. [c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.
