Mr. Bhattacharjee, learned Senior Standing Counsel, who usually represents the State and is present in Court today, is requested to appear in this matter along with a junior of his choice. Let the appointment of Mr. Bhattacharjee along with a junior of his choice be regularized by the concerned authority. Though the petitioners approached this Court with the prayer for consideration of their representation but the learned advocate appearing for the petitioners in course of his argument submits that during the pendency of the writ petition the Sub-Divisional Magistrate, Diamond Harbour, 24 Parganas (South) has issued a notice dated 2nd June, 2026 under Section 10(3) of the West Bengal Highways Act, 1964 fixing the date of hearing on 11th June, 2026. 2 Taking note of the subsequent events that cropped up during the pendency of this writ petition this Court feels that interest of justice would be sub-served if the concerned respondent authority is directed to conclude the proceeding under Section 10(3) of the West Bengal Highways Act, 1964 with a specified time frame. WPA 10083 of 2026 stands disposed of by directing the Sub-Divisional Magistrate, Diamond Harbour, 24 Parganas (South) being the 6th respondent to take up the hearing of the proceeding under Section 10(3) of the 1964 Act on 11th June, 2026, if such proceeding is otherwise ready for hearing and conclude the entire proceeding as expeditiously as possible but positively within a period of four weeks from that date. It will be open to the petitioners and other contesting parties to raise all points before such authority and the authority shall consider the issues raised before such authority and pass a reasoned order. The reasoned order shall be communicated to the parties within the aforesaid time limit. There shall be however no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Hiranmay Bhattacharyya, J.)
