After arguing for a while, when learned counsel for the petitioners was confronted with the maintainability of the instant writ petition, in which the petitioners have called in question the impugned FIR No. 0036 of 2025 dated 07.08.2026 registered with the Police Station, Khour, where serious allegations have been leveled against the petitioners, as the challan has been produced before the competent court of law for judicial determination, seeks withdrawal of the writ petition with liberty to appear before the court where the challan has been filed, i.e. Judicial Magistrate 1st Class, Akhnoor, where the petitioner will take all the available factual and legal grounds.
Accordingly, this writ petition is dismissed as withdrawn with the liberty as prayed for.
It is made clear that no expression of opinion has been made with regard to merits of the case and the learned trial court shall proceed in accordance with law without being influenced by any observation of this Court, which is only for the purpose of deciding the instant petition.
