This revisional application has been filed seeking expeditious disposal of an application filed under Section 34 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereafter as the said SARFAESI Act, 2002) filed by the petitioner in Title Suit No. 1224 of 2023 pending before the learned 3rd Court of the Civil Judge (Senior Division) at Barasat. 2. Mr. Singh, learned advocate appearing for the petitioner submits that the said application under Section 34 of the SARFAESI Act, 2002 was filed as far back as on January 25, 2024 but the same is still pending. 3. In view of the nature of the order proposed to be passed direction for prior service of copy of this application along with notice on the opposite parties is not being made, however, the petitioner shall remain obliged to serve a copy of this application along with a copy of this order upon the opposite parties within a week from date. 4. Since an application under Section 34 of the 2 SARFAESI Act, 2002 assailing inter alia, the maintainability of the suit is pending before the learned Trial Court, since 2024, the learned Trial Court is requested to take up the same and endeavor to dispose it of as expeditiously as possible and preferably within a period of six months from the next date fixed. 5. CO. 671 of 2026 stands disposed of. 6.
