JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question proceedings in Crime No.213/2025, pending before the Principal Senior Civil Judge and CJM, Tumkuru, registered for - 3 - HC-KAR NC: 2026:KHC:29321 CRL.P No. 9317 of 2025 the offences punishable under Sections 406 and 420 of the Indian Penal Code. 2. Heard Sri.S.R.Jagadeesha, learned counsel appearing for the petitioners, Smt.Waheeda M.M, learned HCGP appearing for respondent No.1, Sri.Shivashankar N.S, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit in that regard. The joint affidavit reads as follows: “JOINT AFFIDAVIT We, (1) DHANUSH @ Ramasetti Dhanushya, S/o Chandrashekar Rao, Age 36 year, Presently Residing at, No.24/296 Ramanaidu Peta, Machilipatnam, Krishna District Andrapradesh-521001 (The petitioner No.1 herein) (2) THULASIGANTHA @ Ganta Tulasi, S/o Ganta Jyothi Naidu, Age 42 years, High tech Foods, Bengaluru, Bengaluru City, Karnataka. Resident of, Lakshmipuram, Bangarupalayam, Ragimanipenta, Chittoor, Andhrapradesh-517429. (The petitioner No.2 herein) (3) K.A. ABILASH, S/o Ashok Kumar Shetty, Age 41 year, Residing at, No.4th cross, Siddaramanna Hostile Road, Sidaganga Layout, Tumakuru Town-560001. (The respondent No.2 herein), jointly do hereby swear and affirm an oath as follows: - 4 - HC-KAR NC: 2026:KHC:29321 CRL.P No. 9317 of 2025 1. We state that, the respondent No.1 had initiated the criminal case against the petitioners herein based on the complaint of respondent No.2 vide crime No. 213/2025 for an offence punishable under section 406, 420 of IPC. 2. That, we the petitioners herein, had filed the above petition seeking relief of quashing of the crime No. 213/2025 and all further criminal proceedings initiated against us by the respondents, which is pending before the respondent No.1 police station, during course of hearing this Hon'ble court was pleased to pass an interim order of stay of investigation in the above crime and issued a notice to the respondent No.2. 3. That, we the petitioners and respondent No.2 who is de- facto complainant in order to settle our disputes between us had several discussions in the presence of the elders, well-wishers on such advice both of us have come to amicable settlement accordingly we arrived to the following terms and conditions viz: (a) The petitioners have agreed to pay the total amount of Rs. 9,00,000/- (Rupees Nine Lakhs only) in favour of respondent No.2 accordingly the petitioners have paid an amount of Rs. 3,00,000/- (Rupees Three Lakhs only) in favour of respondent No.2, On 6th February 2026 transferred via NEFT from petitioner No.2 Bank account i.e., from SBI bank to Kotak Mahindra bank stands in the name of 'Karigiri Food Industries' vide UTR No. SBIN126037368859. And an amount of Rs. 6,00,000/- (Six Lakhs only) is paid on this 16th June 2026 in favour of respondent No.2 via RTGS transfer on his bank account, I the respondent No. 2 duly acknowledges the receipt of the aforesaid amount as a full and final settlement amount. (b) On receipt of the full and final settlement amount I the respondent No.2 has agreed to withdraw all allegations made against the petitioners and compromised the matter in crime No.213/2025 registered before the 1st respondent police and agreed to withdraw the same. - 5 - HC-KAR NC: 2026:KHC:29321 CRL.P No. 9317 of 2025 (c) Further, we do have no any either business transactions or monetary transactions between us except the one which alleged in the above crime, therefore we don't have any claims or dues with each other. (d) In terms of the above compromise, we resolved to close the case initiated against the petitioners. (e) We do agree to the above compromise without any force, pressure and undue influence and it is made with our free consent. Hence, we jointly prays that, this Hon'ble High court may be pleased to allow the above petition in the interest of justice and equity. What are all stated above is true and correct the best of our knowledge and belief.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of joint affidavit being filed by the parties to the lis and offences not being against the State, I deem it appropriate to accept the joint affidavit and terminate the proceedings against the petitioners in the subject petition. 6.
