JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 29-06-2026 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner has prayed for bail in connection with Darbhanga Sadar P.S. Case No.90 of 2026 registered for the offence punishable under Sections 309(4) and 3(5) of the BNS. 3. The case of the prosecution, in short, is that unknown miscreants have committed theft in the shop of the informant. 4. Learned counsel appearing on behalf of the petitioner has submitted that the name of this petitioner has surfaced during course of investigation in the confessional statement of one co-accused Ravi. Learned counsel for the Patna High Court CR. MISC. No.41910 of 2026(2) dt.29-06-2026 2/2 petitioner has submitted that in the house of this petitioner, three cartoons of Kwiker written ladies and gents slippers and 8 sacks of eva named slippers were recovered. It has been submitted that from perusal of Annexure-P/2 it will transpire that the petitioner is a shoe seller and that he has purchased the same from one Nitish which transpires from the bank statement. It has been submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 11.03.2026. 5. The application for bail is opposed by learned APP for the State. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S.
