As per the report, the present petitioner, viz, Sudhanshu Biswas, is also known in the locality as Babu Biswas, which is his pet name. Learned counsel for the petitioner submits that the petitioner was not named in the FIR. The victim was in an intoxicated condition and was moving around brandishing a knife and stabbing others with it. When others tried to restrain him, he fell down and subsequently passed away. Learned Additional Public Prosecutor representing the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He refers to the post-mortem 2 report, which shows multiple chop injuries inflicted by sharp-cutting weapon/s. He also relies on the statements of witnesses who have taken the name of Babu Biswas as one of the assailants. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
