In this writ petition, the petitioner is assailing the order dated 02.06.2026 passed by the respondent - 3 - HC-KAR NC: 2026:KHC:30063 WP No. 16489 of 2026 No.1, stating that the petitioner herein has encroached the land belonging to the Government and has undertaken construction in the said land. Accordingly, the impugned Memorandum has been passed by the respondent No.1, taking into consideration the fact that the respondent- authorities herein are claiming that the petitioner has made an attempt to construct the building in the land belonging to the Government. I am of the opinion that there is no impediment in issuing the memorandum at Annexure-A, directing the petitioner to remove such encroachment if any. However, in order to resolve the dispute as to the identification of the property is concerned, respondent-authorities are permitted to conduct joint survey in the presence of the petitioner by the jurisdictional Assistant Director of Land Records, Belthangady Taluk along with respondent No.1 to verifty if any encroachment is being made by the petitioner, and if any, same may be removed.
