JUSTICE M.NAGAPRASANNA and HON'BLE MR. JUSTICE VENKATESH NAIK T ORAL ORDER (PER: HON'BLE MR. JUSTICE M.NAGAPRASANNA) Petitioners are before this Court seeking the following prayer: “a. Writ of mandamus directing the Respondent No.3 to consider the Representation of the petitioner dated 24/11/24 vide Annexure – E b. Writ of mandamus directing the Respondent No.3 herein to allot the alternative site to the petitioner in the interest of justice and equity.” 2. Heard Smt. Archana Murthy, learned counsel for petitioners, Smt. Hemalatha V., learned Additional Government Advocate for respondent No.1 and Sri Shivaprasad M. Shantanagoudar, learned counsel for respondent Nos.2 and 3. 3. Learned counsel for the petitioners submits that the petitioners had constructed a residential house prior to the preliminary notification dated 30.12.2018 and the subject land - 4 - HC-KAR NC: 2026:KHC:30209-DB WP No. 6676 of 2026 being acquired for the formation of Dr. Shivaram Karanth Layout has submitted a representation for grant of an alternate site. The representation not having met its consideration, has preferred this petition before this Court. 4. Sri Shivaprasad M. Shantanagoudar, learned counsel for respondent Nos.2 and 3 – Bengaluru Development Authority submits that if reasonable time is granted, the representation of the petitioners would be considered and necessary orders would be passed in accordance with law. 5. In the light of the aforesaid submissions, we deem it appropriate to pass the following: ORDER a. The writ petition stands disposed. b. Respondent Nos.2 and 3 – Bangalore Development Authority to consider the representation submitted by the petitioner, dated 24.11.2025, within a period of twelve weeks, from the date of receipt of a copy of the order. - 5 - HC-KAR NC: 2026:KHC:30209-DB WP No. 6676 of 2026 c. Respondent Nos.2 and 3 – Bangalore Development Authority shall also communicate the order that would be passed on the representation, to the petitioner. Ordered accordingly.
