OMP(M) No.264 of 2026 By way of the present application, a prayer has been made to condone the delay. As per the application, there is delay of 397 days in filing the main appeal. The said delay has been sought to be condoned on account of administrative exigencies, as mentioned in the application. The application is supported by the affidavit of Project Director NHAI. Despite service of notice, the respondent has not bothered to put appearance and to controvert the contentions, as mentioned in the application. As such, the application under consideration is allowed and the delay, as occurred, in filing the main appeal, is ordered to be condoned. The application stands disposed of. Arb. During the pendency of the appeal, the execution of the award dated 06.06.2023, passed in Case No.346/20, by the Divisional Commissioner, exercising the powers of Arbitrator under the National Highways Act, 1956, is ordered to be stayed, subject to deposit of the entire awarded amount, together with upto date interest, within a period of eight weeks.
