Das, APP Ms. Nayana Mukhopadhyay … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year five months and till date out of the 11 witnesses cited by the prosecution, only one witness has been examined. Therefore, he prays that the petitioner may be released on bail as there is no possibility of the trial being completed very soon. Learned advocate for the State opposes the prayer for bail. However, having regard to the period of detention of the present petitioner, I direct that the learned trial court would in the next two schedules try to complete the evidence of seizure list witnesses. After that, if any application for bail is advanced, the learned trial court would 2 assess regarding the culpability of the present petitioner, thereafter, if it is satisfied, will release the petitioner on bail. It has been informed that the petitioner is presently admitted in jail hospital. If any application is preferred so far as the health issues of the present petitioner is concerned - which warrants further treatment, necessary directions be passed by the learned trial court.
