JUSTICE D K SINGH) This intra-court appeal has been filed impugning the judgment and order dated 18.12.2023 passed by the Writ Court. 2. The Karnataka State Road Transport Corporation1 filed the writ petition impugning the award passed by the Industrial Tribunal, Mysore, in Reference No.18/2016 dated 22.11.2018, whereby the learned Industrial Tribunal allowed the reference and set aside the order of minor punishment inflicted on the appellant for four months long absence from the duty i.e., from 09.04.2008 to 24.07.2008 (106 days). 1 For short ‘KSRTC’ - 3 - HC-KAR NC: 2026:KHC:28962-DB WA No. 1519 of 2026 3. The appellant was appointed as Traffic Controller in the establishment of the KSRTC. He remained unauthorisedly absent from duties from 09.04.2008 to 24.07.2008. The appellant was issued call letters on 06.05.2008 and 10.07.2008 calling upon him to join his duties, but the call letters remained unanswered. 4. When the appellant did not answer call letters, he was issued with Article the Charge on 15.07.2008 for long absence from duties from 09.04.2008 to 24.07.2008. The Enquiry Officer submitted the report dated 03.11.2009 finding the charges proved. The Disciplinary Authority inflicted the punishment vide order dated 27.11.2009. Said order of punishment came to be challenged after lapse of six years. The learned Single Judge has considered all aspects of the matter and has come to the conclusion that the order passed by the learned Industrial Tribunal is unsustainable. The learned Industrial Tribunal has lost sight of the fact that the order of punishment was challenged after six long years. - 4 - HC-KAR NC: 2026:KHC:28962-DB WA No. 1519 of 2026 5. We have gone through the impugned judgment and order passed by the learned Single Judge and we find no error either in law or of facts, which requires interference in this appeal.
