Mr. M.S. Pal, learned Senior Counsel assisted by Mr. D.S. Mehta, learned counsel for the petitioner. 2. Mr. Rajeev Singh Bisht, learned Additional C.S.C. for the State of Uttarakhand. 3. Petitioner was appointed as Gram Panchayat Vikas Adhikari in the year 1999 and he is serving in District Pithoragarh. According to him, he is entitled to benefit of 2nd ACP which is payable after completion of sixteen years of satisfactory service, but such benefit has not been given to him so far. 4. Learned counsel for the petitioner points out that earlier an FIR was registered against the petitioner under Sections 420, 467, 468 & 471 IPC, and upon investigation, police filed charge- sheet against him in the court of CJM, Pithoragarh; however, coordinate Bench vide judgment dated 22.12.2025 passed in Criminal Miscellaneous Application (C- 482) No. 1793 of 2017 was pleased to quash the entire proceedings of Criminal Case No. 1443 of 2017. 5. It is thus contended that there was no adverse material available against the petitioner which may justify denial of 2nd ACP to the petitioner. 6. Learned State Counsel submits that since petitioner has prayed for a writ of 2026:UHC:1480 mandamus, but he has not made any formal representation to the Competent Authority, therefore, petitioner can be permitted to approach the Competent Authority by making representation. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the Competent Authority within two weeks from today. If he makes representation within stipulated time, decision thereupon shall be taken by the Competent Authority, as per law, within three months thereafter.
