V V SATISH 5 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 10921 of 2026 The Court made the following Order: Instant Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India is filed for the following relief: “.... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents in withholding the payment of pt and final bill amount of Rs.4,28,650/-, Rs. 4,28,650/-, Rs.4,28,650/- Rs.4,28,650/- Rs. 4,28,650/- and Rs. 4,28,650/- respectively Totally an amount of Rs. 25,71,900/- even after finalizing the bills payable to the petitioner in relation to the works i.e., 'Land Leveling in APIIC Layout -II Mudupulavemula (ID.No.02174LA002602) Mudupulavemula Grama Panchayat of Jaganna Housing Layout Colony of Filer Mandal, Annamayya District, is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment of amount of Rs.4,28,650/-, Rs. 4,28,650/-, Rs.4,28,650/- Rs.4,28,650/- Rs. 4,28,650/- and Rs. 4,28,650/- respectively Totally an amount of Rs. 25,71,900/- with interest @24percent per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith and pass such other order …”. 2. All the petitioners are agriculturists having small extents of land in and around Hussainapuram Village, Orvakal Mandal, Kurnool District. 3. Learned counsel for the petitioners though raised several contentions in the instant lis, presently, he seeks permission of 6 this Court to prefer representations to the District Collector, with all the relevant documents and a direction may be given to consider the same in accordance with the specific guidelines issued by Union of India. 4. Learned Government Pleader for Revenue appearing for respondent Nos.5 and 6 submits that in the event the petitioners prefer any representations, the same will be considered by duly taking note of the guidelines issued by Union of India. 5. In the light of the above facts and circumstances, the Writ Petition is disposed of with the following terms: i) All the petitioners are permitted to prefer written representations by enclosing all the relevant documents substantiating their assertions before the Respondent No.5- District Collector, within a period of two (02) weeks from today. ii) On receipt of such representations, respondent No.5 is directed to consider and pass appropriate orders, by giving due opportunity to the petitioners and by strictly following the guidelines issued by the Government of India, vide F.No.3/4/2016-Trans-Part(4), dated 14.06.2024 and 7 communicate the same, to the petitioners through speed post with acknowledgment due, within a period of three (03) months, from the date of receipt of said representations.
