The petitioner has sought the following relief(s):- “10.i. That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to extend the benefit of second and third time 2 scale of pay, in accordance with the prevalent circulars/orders of the State Government, in favour of the petitioner, along with all other consequential benefits along with arrears, from the date of his actual entitlement and further direct that the order dated 14/06/2021 (P-4) be also be suitable modified to that extent. ii. Cost of the petition may also be granted to the petitioner. iii. Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.” 2. Learned counsel appearing for the petitioner would submit that the petitioner was appointed on the post of Assistant under the respondent department vide order dated 30.08.1989. He has completed 30 years of service and, according to the circular dated 28.04.2008, is entitled to the benefit of time-scale pay after completion of 20 and 30 years of continuous service. He would submit that a direction may be issued to the respondent authorities to consider the claim of the petitioner and take an appropriate decision in this regard. 3. On the other hand, learned State counsel would oppose the submissions made by the counsel for the petitioner and submit that the petitioner has already been promoted to the post of Superintendent in the department vide order dated 28.07.1997 and, therefore, he is not entitled to receive the benefit of the time-scale pay; thus, the petition deserves to be dismissed. 4. Heard. 5. It is not in dispute that the petitioner has completed more than 30 years of service. According to the circular dated 28.04.2008, a Government employee is entitled to the benefit of time-scale pay on completion of 10, 20 and 30 years of service. The petitioner has already 3 been granted the first time-scale pay and, by filing the present petition, has claimed the second and third time-scale pay benefits. 6. According to respondents, the petitioner has already been promoted to the post of Superintendent, the benefit of time-scale pay can not be extended. It would be relevant to discuss Clause 4 of the circular dated 28.04.2008, which clearly states that Government servants who have been granted promotion would be entitled to the benefit of time-scale pay. Clause 4 of the circular dated 28.04.2008 is reproduced hereinbelow:- “4. इस योजना के अंतर्गत निनार्धारित शत के अंर्धाना उच्चत वे तनामाना के पात्रत उना शसकेयो स वेके के भी होर्ग जिजन्हो$ प्रानिभीके निनायो&नि' के पाद स एके, द अंथवे द स अंजिर्धाके पादन्ननित के लाभी प्राप्त हो च&के हो. ।” 7. Considering the Clause 4 of the circular dated 28.04.2008 and the facts of the present case, the petitioner is permitted to submit a detailed representation before respondent No. 2 and in turn, the authority concerned is directed to consider the claim of the petitioner in the light of the observations made hereinabove and in accordance with Clause 4 of the circular dated 28.04.2008. 8. The entire exercise shall be completed within a period of 90 days from the date of receipt of a copy of this order. 9.
