ORDER The present petition has been filed seeking a direction to the learned Judicial Magistrate No.II, Usilampatti, to consider the warrant recall petition filed by the petitioners for recall the Non Bailable Warrant issued on 29.01.2026 against them in connection with a case in S.T.C.No.240 of 2023 which filed by the complainant.
2. The petitioners are facing trial since 17.04.2023 and the case was posted for questioning under Section 313 of Cr.P.C. The petitioners have filed an application to dispense their personal appearance for the hearing under 2/5 https://www.mhc.tn.gov.in/judis
Section 355 BNSS and the same was dismissed by learned Judicial Magistrate on 29.01.2026 and NBW was issued against the petitioners. Now the case is posted for hearing on 09.04.2026. Hence this petition. 3.Heard the learned counsels on either sides and perused the materials available on records.
4. Considering the averments in the petition, there shall be a direction to the learned Judicial Magistrate No.II, Usilampatti,to accept the warrant recall petition against NBW issued as against the petitioners in S.T.C.No.240 of 2023. The petitioners are directed to co-operate for the trial. In case of any non- appearance in future, it is made clear that they would not have benefit of the
order of this Court.
