KAMAL ORAL ORDER This petition is filed by a tenant in respect of a premises belonging to respondent No.3-Ranganathaswamy Temple being aggrieved by the proceeding initiated under sub-section (1) of Section 5 of Karnataka Public Premises (Eviction of Unauthorised Occupants) Act, 1974 (For short ‘Act’) resulting in - 3 - HC-KAR NC: 2026:KHC:30430 WP No. 5455 of 2022 petitioner being held as an unauthorised occupant and being directed to vacant the premises. 2. Perusal of the impugned order as per Annexure-C would indicate that a notice is stated to have been served on the petitioner on 16.07.2020. And since there was neither any representation nor any objections are filed on behalf of the petitioner, the competent authority has proceeded to pass the impugned order on 11.11.2021 by relying upon the contents of the application filed by the respondent No.2- Institution. 3. Clearly, there appears to be no proper opportunity being afforded to the petitioner. In the factual aspect of the matter, petition is disposed of. The impugned order dated 11.11.2021 passed by the respondent No.2 vide Annexure-C is set aside. Matter is remitted to the Competent Officer. Petitioner who is now represented by the counsel shall appear before the Competent Officer on or before 15.07.2026, without expecting any further notice. The petitioner shall also file objections if any, within 15 days of the next date of hearing fixed as above and the Competent Officer shall proceed with - 4 - HC-KAR NC: 2026:KHC:30430 WP No. 5455 of 2022 the matter and pass orders in accordance with law within an outer limit of 3 months thereafter. 4.
