This Court, vide order dated 15.09.2023 passed in CRR No. 450 of 2013, while dismissing the petition of the petitioner, namely, Liu Gaoxuan, had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of one year from the date of passing of the order, if there was no legal impediment. 3. Earlier on multiple occasions also this Court had granted extension of time for compliance of the order dated 15.09.2023. KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN 2 4. The learned learned Special Judge SC/ST (P.A) Act, District-Korba (C.G.), vide its request letter dated 06.05.2026 has requested for grant of four month’s additional time for concluding the trial. 5. It transpires from perusal of the P.U.D. that a Special Public Prosecutor, namely Shri Sudhir Kumar Bajpai, was appointed by the State on 01.05.2026 and he entered appearance in the matter for the first time on 06.05.2026. On the said date, the evidence of one prosecution witness was recorded. It is further revealed that an application filed by the erstwhile Public Prosecutor is pending consideration and time has been sought on the ground that the newly appointed Special Public Prosecutor could not sufficiently examine the record for advancing arguments thereon. The remaining prosecution witnesses have again been summoned through bailable warrants issued via the Superintendent of Police and the case has been fixed for prosecution evidence on 19.05.2026. The P.U.D. further reveals that three of the accused persons, namely Wu Chunan, Liu Gaoxuan and Wang Weiging, are foreign nationals. In view of the directions issued by the Hon'ble Supreme Court in CRLMP Nos. 8824 and 8825 of 2013 (Wu Chunan and Others v. State of Chhattisgarh) and the undertaking furnished by the Consulate of the People's Republic of China, necessary intimation has been given to the representatives/counsel of the said accused persons as well as to the Consulate for securing their presence before the trial Court. Owing to the involvement of foreign nationals, their appearance before the Court is likely to consume considerable time. It is further submitted that the case is presently at the stage of prosecution evidence and sincere efforts are being made for its expeditious disposal. However, several prosecution 3 witnesses are residents of other States and, considering the antiquity of the case, difficulties are being faced in tracing and securing their attendance despite continuous efforts. In the aforesaid circumstances, the learned trial Court has sought extension of time and has prayed for grant of a further period of six months for concluding the trial and final disposal of the case. 6. The request appears to be reasonable. The concerned trial Court is directed to conclude the trial as early as possible, preferably within a further period of six months from today. 7. Accordingly, this CRMP stands disposed off with the aforesaid direction. 8.
