Ajay Mohan Goel, Judge (Oral) This Court questioned learned counsel for the applicant/petitioner qua the maintainability of this petition on the ground that the impugned order was dated 03.08.2023 and the petition was filed belatedly. 2. In response thereto, learned counsel for the applicant/petitioner submits that what has necessitated the filing of this petition is a subsequent order passed by the learned Court below in proceedings initiated by the wife under Section 125 of the Cr.P.C. 2 3. According to us, this is no ground to agitate order dated 03.08.2023 with which applicant/petitioner apparently was not dissatisfied at the earlier stage. 4. Faced with this situation at this stage, learned counsel for the applicant/petitioner submits that the applicant/petitioner be allowed to withdraw this application. 5.
