The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.279/2026 registered at Police Station Akaltara, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.06.23 15:39:12 +0530 2 Dist.- Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 119(1), 296, 351(3) of B.N.S. 2. Case of the prosecution, in brief, is that complainant Jitesh Kumar Netam lodged the FIR on 19.05.2026 stating that on 18.05.2026 at about 09:30 P.M. when he was standing in front of shop of one Sanjay Sahu at that the applicant came on the spot, that after seeing the applicant the complainant was going to his home, then the present applicant stopped him and took the key of the motorcycle and demanded money for consuming liquor, that when the complainant denied to give the amount the applicant used filthy language against him and made assault with hand and gloves as a result he received he injury near right eye and cheek. On the complaint of the complainant Police Station Akaltara, Dist- Janjgir- Champa (C.G.) registered the Crime No. 279/2026 dated 19.05.2026 for the alleged offences punishable U/s 119(1), 296, 351(3) of B.N.S. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He submits that the dispute arose over a trivial issue regarding payment of Rs. 500/- for installation of a tent at the applicant's house and, during the altercation, both parties assaulted each other and sustained simple injuries. It is further submitted that the dispute was amicably settled through the intervention of senior members of the society and both parties had agreed not to lodge any complaint. He further submits that the applicant is a young 3 man, his continued detention would adversely affect his future, and he is a permanent resident of District Janjgir-Champa with no likelihood of absconding or tampering with the prosecution evidence. He would submit that the applicant is ready to cooperate with the investigation and abide by any condition imposed by this Court, therefore he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State Counsel opposes the prayer for grant of anticipatory bail and submits that the allegation against the applicant is that he assaulted the complainant/injured with hands and fists after demanding money from him for consuming liquor. He further submits that three other criminal cases of a similar nature are also pending against the applicant. Therefore, the applicant is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegations, the specific accusation that the applicant assaulted the complainant after demanding money for consuming liquor, and the fact that three other criminal cases of a similar nature are pending against the applicant, therefore this Court is not inclined to grant anticipatory bail to the applicant. 4 7. Accordingly, the anticipatory bail application of the applicant - Sagar Ogre, involved in Crime No.279/2026 registered at Police Station Akaltara, Dist.- Janjgir-Champa (C.G.) for alleged commission of offence punishable under Sections 119(1), 296, 351(3) of B.N.S. is rejected.
