JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accept notice for respondent Nos.1 to 3. 2. Petitioner is before this Court seeking for the following reliefs: a. Issue writ of Mandamus directing the Respondent No.3 Police to Register the FIR pursuant to the complaint dated 26.03.2026 against the proposed Accused who the Respondent No.4 to 6 as per Annexure 'A'. b. Pass such other direction or order as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity. 3. The petitioner has submitted a complaint on 26.03.2026 to respondent No.3 against respondent Nos.4 to 6 raising certain allegations against them. The said complaint was not registered, a Non-Cognizable Report (NCR) came to be issued by respondent No.3 on 12.04.2026, stating that the disputes are civil in nature and has directed them to approach the appropriate forum. - 4 - HC-KAR NC: 2026:KHC:30188 WP No. 18215 of 2026 4. The submission of Mr. M.R.Balakrishna, learned counsel for the petitioner is that the perusal of the complaint would indicate that there are allegations made which would amount to offence under Section 85 of the Bharathiya Nyaya Suraksha Sangha (BNSS), 2023. On that ground, he submits that the complaint ought to have been registered. 5. A perusal of the endorsement indicates that a preliminary enquiry has been made by the jurisdictional police and the investigating officer is of the opinion that the disputes are civil in nature. 6. A perusal of the complaint would also indicate that the allegations made are as regards the factory and the business of the petitioner and her husband, who is none other than the son of respondent No.4 and brother of respondent No.5. The husband has not joined the petitioner in filing the complaint, though allegations are made that it is the petitioner and her husband who have been harassed and threatened. Essentially, all these - 5 - HC-KAR NC: 2026:KHC:30188 WP No. 18215 of 2026 relate to the business being carried out and the income from the said business. 7. Hence, I am of the considered opinion that there being no allegation made by the petitioner against the husband, but only against the mother-in-law and sister-in-law. The allegations relating to the business being carried out. No fault can be found with the endorsement, which had been issued by the respondents. 8.
