Balwant Singh v. Hakam Singh & Others
CMP (M) No.448 of 2026 [Item D-2]
11.09.2026. Present: Mr. Virender Chauhan, Advocate for
Mr. Surender Saklani, Advocate, for the
applicant-petitioner.
Ms. Shrishti Ramesh, Advocate for Mr. Parav Sharma, Advocate, for respondent No.1.
Mr. Rakesh Dhaulta, Additional Advocate General, for respondents No.2 & 3-State.
CMP (M) No.448 of 2026 The present application has been filed for condonation of delay in filing the Review Petition against the order dated 18.07.2025, passed in LPA No.22 of 2025, titled as Balwant Singh v. Hakam Singh and Others.
2.
The plea taken is that the matter had been taken to the Apex Court by filing an SLP on 08.12.2025, wherein liberty was granted to the applicant to bring the site plan to the notice of this Court for ventilating his grievance.
3.
It is pointed out that, thereafter, this Court remained closed for winter vacation from 12.01.2026 to 22.02.2026 and on reopening of the Court, counsel was engaged. It is, thus, submitted that there was a delay of around 25 days in filing
the Review Petition, whereas the Registry has calculated the delay as 256 days.
4.
The application has been opposed by filing a reply on the ground that the limitation expired on 16.01.2026 whereas the Review Petition was filed on 19.03.2026 resulting in an unexplained delay of 62 days.
5.
Keeping in view the settled principles of law laid down in Collector, Land Acquisition, Anantnag vs. Smt. Katiji and others, (1987) 2 SCC 107, that each and every day’s delay is not to be explained and a liberal approach is to be adopted while considering an application for condonation of delay, we are of the considered opinion that the application is liable to be allowed as sufficient cause has been made out.
6.
Accordingly, the application is allowed and delay in filing the Review Petition is condoned.
7.
The application stands disposed of.
8.
Review Petition be registered. Review Petition No.95 of 2026
9.
Notice. Ms. Shrishti Ramesh, Advocate, appearing for respondent No.1 and Mr. Rakesh Dhaulta, learned Additional Advocate General, for
respondents No. 2 & 3, accept and waive service of notice.
10. To come up for consideration on
06.11.2026.
