Petitioner has filed this writ petition seeking following reliefs: “10.1 That, the Hon'ble Court may kindly be directed to the respondents to release the over time allowance with interest 12% during the duty period engaged in legislative Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.01.09 17:44:28 +0530 2 / 2 assembly election held in the year 2023 as applicable in the case of the petitioner. 10.2 Any other relief, which this Hon'ble Court may deem fit and proper according to the facts and circumstances of the case along-with the cost of the petitioner.” 2. Learned counsel for the petitioner submits that petitioner while working as Assistant Grade-II was deployed for printing of papers to be used in elections. Looking to the pressure of work, to be completed in specific time, petitioner has to do overtime. However, no additional pay towards overtime has been paid to petitioner. Petitioner thereafter had submitted representation before respondent No.3. Though respondent No.3 has acknowledged the work done by petitioner however, he has not acceded to claim of petitioner for grant of overtime pay on the ground that there is no directives in this regard from superior authority. 3. In the aforementioned facts of case where the claim of petitioner is still to be considered by the authority for grant of overtime pay under the Saskiya Mudranalaya Karkhana Adhiniyam, 1948 and MP/CG Jildsaji Niyam, 1957 and therefore writ petition is disposed of at this stage permitting the petitioner to submit comprehensive representation along with all relevant documents before respondents No. 1 & 2 and in the event petitioner submits such representation, concerned authority shall consider and decide the same within a further period of 4 months from the date of receipt of representation.
