The Court made the following: 3 THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI CIVIL REVISION PETITION NO: 969/2026 ORDER: On 10.04.2026, the following order was passed: “1. Heard Sri Alladi Radha Krishna, learned counsel for the Petitioners. 2. The Petitioners are the Plaintiffs (wrongly mentioned as Defendants in the array of parties) in O.S.No.27 of 2019, which was pending in the Court of Principal Junior Civil Judge, Chodavaram. The Respondents are the Defendants (wrongly mentioned as Plaintiffs in the array of parties). In the said suit, the Plaintiffs filed an application for grant of Temporary Injunction and the Trial Court passed the following order:- “In the result, the petition is allowed by granting Temporary Injunction in favour of the petitioners and against the respondents 1 to 5 and their men in any way interfering with the peaceful possession and enjoyment by the petitioners over the plaint schedule property till the disposal of the main suit. No costs.” 3. Learned counsel for the Petitioners submitted that Respondents tried to create some hindrance and consequently, the Plaintiffs filed I.A.No.31 of 2025 seeking for a direction to the Station House Officer of Chodavaram Police Station, Anakapalli District for grant of police aid It was submitted that in the said application, the arguments of the Plaintiffs were completed on 06.05.2025 and inspite of the matter coming up for arguments of the Respondents, the Respondents sought for almost 15 adjournments, but the arguments were not advanced and the application is still pending for consideration. 4. The present C.R.P was filed seeking for a direction for expeditious disposal of I.A.No.31 of 2025 in I.A.No.53 of 2019 in O.S.No.27 of 2019. 5. Learned Trial Court is directed to submit a report to this Court with respect to the I.A.No.31 of 2025 with regard to the arguments of the Plaintiffs/Petitioners, which were completed on 06.05.2025, and as to why the application has not been decided yet. 6. List the matter on 01.05.2026.” 2. The report dated 28.04.2026 has been received from the learned Principal District Judge, Visakhapatnam along with the report of learned Principal Civil Judge (Junior Division) Court dated 20.04.2026. 4 3. On perusal of such report as also in view of submissions advanced it transpires that the respondent has not shown interest, as Assistant Government Pleader, is not appearing on various dates to advance the arguments. 4. Learned Principal Civil Judge (Junior Division), Chodavaram has mentioned in the report that much endeavor was made to dispose of I.A.No.31 of 2025 but for the said reason of no assistance or cooperation in arguments by the learned Assistant Government Pleader for the respondents, the matter could not be disposed of. 5. In view of the aforesaid submission, this Civil Revision Petition is being disposed of finally with the direction to the learned Court to consider and decide I.A.No.31 of 2025 in O.S.No.27 of 2019 expeditiously within a period of two months from the date certified copy of this order is placed before the said Court, in accordance with law, even if the respondent does not respond or learned Assistant Government Pleader does not argue the matter and in such a case by resorting to the appropriate legal procedure, open under such a circumstance. No order as to costs.
