JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: i. Issue a writ in the nature of Mandamus, or any other appropriate writ, order, or direction, directing the Respondent to consider and decide upon the Petitioner's representation dated 15/02/2025 and calculate the interest accrued on the deposited Amount of Rs.1,00,00,000/- from 19-07-2018 to 02-11-2024 and pay the same at Annexure-A in accordance with law and within a time-frame deemed appropriate by this Hon'ble Court. ii. Pass such other and further orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, including any consequential orders, in the interest of justice and equity. 2. The petitioner was convicted for offences punishable under Section 13(1)(e) read with Section 13(2) of the Prevention of Corruption Act and was ordered to pay ₹ 3,00,00,000/- as fine vide order dated 18.06.2018 in Special C.C.No.122/2009. An appeal in Criminal Appeal No.1170/2018 having been filed, the same came to be reduced to ₹ 1,00,00,000/- which was deposited by the petitioner on 19.07.2018. 3. In the said appeal, the petitioner was acquitted and the trial court was directed refund the fine amount if - 3 - HC-KAR NC: 2026:KHC:29434 WP No. 21438 of 2025 any in deposit. The petitioner having received the fine amount has submitted a representation that the petitioner would also be entitled to interest from the time of deposit till the date of refund and in that background a representation has been submitted on 15.02.2025 which has not been considered. 4. Whenever any request is made to authority, it is required that the same is considered and necessary orders passed within a reasonable period of time either accepting or rejecting the request made. 5. In the present case, the request having been made on 15.02.2025 has been pending for more than a year, which cannot be said to be reasonable. In that view of the matter, I pass the following: ORDER i) The Writ Petition is partly allowed ii) A mandamus is issued directing respondent to consider the representation of the petitioner dated 15.02.2025 at Annexure-A and pass necessary orders thereon within a period of 30 days from date of receipt of a copy of this order. - 4 - HC-KAR NC: 2026:KHC:29434 WP No. 21438 of 2025 iii) It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner.
