APHC010380072021 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3521] SATURDAY,THE SEVENTH DAY OF MARCH TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE DR JUSTICE Y. LAKSHMANA RAO CRIMINAL PETITION NO: 5728/2021 Between: 1.RAYANI RAMANJAYANEYULU, S/O. GOVARDAN, 60Y, R/O. FLAT NO. 21, GARUDADHRI TOWERS, NEAR CHANDRA GAS, MARUTHI NAGAR, GUNTUR CITY, GUNTUR DT. ...PETITIONER/ACCUSED AND 1.KANDHIMALLA SRINIVASA RAO, S/O. SREE RAMULU, 58Y, R/O. INKOLLU VILLAGE AND MANDAL, PRAKASAM DT. 2.THE STATE OF ANDHRA PRADESH, REP BY PUBLIC PROSECUTOR, HIGH COURT AT AMARAVATHI. ...RESPONDENT/COMPLAINANT(S): Counsel for the Petitioner/accused: 1.PONNAM RAVINDRA BABU Counsel for the Respondent/complainant(S): 1.PUBLIC PROSECUTOR (AP) 2. The Court made the following: 2 ORDER: Despite the matter having been listed, there has been no representation on behalf of the Petitioner and Respondent No.1. Even after affording sufficient opportunity, neither the Petitioner nor his Counsel has chosen to appear or prosecute the case. The case is before the learned Trial Court for cross-examination of the Respondent. It is also pertinent to observe that the present case constitutes one of the oldest matters pending on the roster. The non- appearance of the Petitioner, despite the long pendency of the matter, reflects a lack of diligence. In view of the absence of representation and the failure to advance arguments, this Court is of the opinion that the Petitioner is not interested in pursuing the present proceedings. Accordingly, the Criminal Petition is dismissed for non- prosecution. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ Dr. Y.
