The petitioner is before this Court seeking for the following reliefs: "i.) Issue writ in the nature mandamus to directing the respondent No.2 i.e. Rajiv Gandhi Rural Housing Corporation Ltd., & Karnataka State Habitat Centre to consider the representations at ANNEXURE-AA, dated 12-01-2017, ANNEXURE - AB dated 28-01-2017, ANNEXURE-AC dated 02-01-2018 and consequently direct the respondent No.2 to act on the MOU dated 17.05.2004 vide ANNEXURE- B. or ii) Alternatively direct the Respondent No.2 to handover the vacant land in survey numbers such as 108, 109, 110 and 111 for an extent of 12 acres 20 guntas as compensation/damages to the Petitioner out of the said MOU as One- - 4 - HC-KAR NC: 2026:KHC:29907 WP No. 2243 of 2024 time-Settlement (OTS) in the interest of justice and equity. iii) Pass such other writ, direction or any other relief as this Hon'ble Court deems fit in the facts and circumstances of this case, in the interest of justice and equity." 2. The grievance of the petitioner is that the representation dated 12.01.2017 (Annexure - AA), 28.01.2017 (Annexure - AB) and 02.01.2018 (Annexure - AC) have not been considered by the respondents. 3. An alternative relief has been sought for directing respondent No.2 to hand over vacant land in Survey Nos.108, 109, 110 and 111, measuring an extent of 12 acres and 20 guntas, as compensation/damages to the petitioner. I am of the considered opinion that the said alternative prayer cannot be granted, as it would amount to enforcement of a contract. Insofar as the consideration of representations is concerned, once a representation is submitted, it was incumbent - 5 - HC-KAR NC: 2026:KHC:29907 WP No. 2243 of 2024 upon the respondent to consider the same and pass appropriate orders thereon. 4. Insofar as the prayer seeking for issuance of a mandamus is concerned, as indicated supra, the representations were submitted in the year 2017, whereas the present petition has been filed on 16.01.2024. This Court is of the considered of the opinion that the claim is stale. A petition filed after nearly eight years seeking consideration of the representations cannot be entertained after such an inordinate delay. No grounds are made out for grant of the reliefs sought.
