KAMAL ORAL ORDER The petitioner is before this Court being aggrieved by the show cause notice dated 07.10.2016 issued by respondent No.3, in terms of which petitioner has been called upon to show cause as to why action should not be taken against petitioner for manufacturing / selling Agarbatti / Incense sticks / liquid contained with chemical pesticides without registration and manufacturing license under Section 9 of the Insecticides Act, 1968 (for short 'the Act, 1968').

Learned counsel for the petitioner submits that response in this regard has already been submitted by the petitioner. He contends that the respondent could not have in the first place issued such a show cause notice in the light of provisions provided under Section 38 of the Act, 1968, wherein according to the petitioner, the product manufactured and being sold by him are exempted.

Learned counsel for the respondent on the other hand submit that the authorities have not passed any order yet on the reply submitted by the petitioner to the show cause notice, the petition is therefore premature, the authority will pass appropriate order considering the cause shown by the petitioner. It is only thereafter petitioner aggrieved if any question of his approaching this Court would arise.
4. Heard, perused the records.
5. Annexure-A is merely a show cause notice. Reply of the petitioner to the said show cause notice is produced at Annexure-L. The petitioner has raised grounds in the show cause notice as that of the one raised in this writ petition. No, order has been passed by the respondent-Authority in furtherance to the said show cause notice. In that view of the matter as rightly contended by the learned counsel for the respondent, the petition is premature, reserving liberty to the petitioner to
