Heard Mr. Suresh Kumar Verma, learned counsel for the 2 petitioner. Also heard Mr. S.S. Baghel, learned Government Advocate for respondents / State. 2. The present writ petition has been filed by the petitioner with the following prayers: “10.1 That the Hon'ble Court may kindly be pleased to allow this writ petition and direct the respondent authority to filed a charge sheet of the FIR no. 402/2024 of the police station Vidhan Sabha District Raipur in offence under section 316(4) and also the Hon'ble Court direct the respondent authority to arrest the accused (Hansh Kumar Paswan), in the interest of justice. 10.2 Any other relief, which this Hon'ble Court may deem fit and proper according to the facts and circumstances of the case along with the cost of the petition.” 3. Learned counsel for the petitioner submits that the petitioner, being the proprietor of Adarsh Fuel, Nardaha, lodged FIR No. 402/2024 at Police Station Vidhan Sabha, District Raipur, alleging that the accused, Hansh Kumar Paswan, who was working as a Manager at the petitioner’s petrol pump, had misappropriated and embezzled an amount of approximately Rs.31,42,654/- by dishonestly retaining sale proceeds of petrol and diesel, including amounts payable by various transport operators, during the period from 30.06.2024 to 13.07.2024. It is contended that despite registration of the FIR and repeated representations dated 30.12.2024, 08.01.2025 and 05.05.2025 requesting arrest of the accused and recovery of the embezzled 3 amount, the respondent authorities have neither arrested the accused nor filed the charge-sheet. Learned counsel submits that the inaction of the investigating agency is arbitrary and contrary to law, resulting in grave prejudice to the petitioner, who has suffered substantial financial loss and continues to face severe financial hardship on account of non- recovery of the misappropriated amount. It is, therefore, prayed that appropriate directions be issued to the respondent authorities to conclude the investigation expeditiously and take necessary steps in accordance with law. 4. On a specific query put by this Court regarding the status of investigation and filing of the police report, learned State counsel submitted that the investigation is at its concluding stage and sought three weeks’ time for filing of the police report. 5. Considering the submissions advanced by learned counsel for the parties and upon perusal of the material available on record, this Court deems it appropriate to dispose of the present petition with a direction to the respondent authorities to conclude the investigation and file the police report strictly in accordance with law within a period of three weeks from the date of receipt of a certified copy of this order.
