For Petitioners : Mr.P.Suresh For Respondents : Mr.B.Thanga Aravindh Government Advocate(crl.side) for R1 Mr.R.Vinoth (for R2) ORDER The present petition has been filed by A1 in Crime No.484 of 2014 on the file of the first respondent Police seeking to quash the FIR in Crime No.484 of 2014 on the file of the first respondent Police against the petitioner, wherein the petitioner has committed the offence under Sections 147, 294(b), 324, 307 and 506(ii) of IPC. 2.A perusal of the FIR would reveal that the fourth respondent is alleged to have attacked the defacto complainant with a stone, and the first accused is alleged to have used a knife and caused an injury on the left side of the head. It could also be seen that the de facto complainant had taken first aid at the hospital and thereafter lodged a police complaint. In such circumstances, at the most, the petitioner could be charged only for the offence under Section 326 of IPC and not under Section 307 of IPC. 2/5 https://www.mhc.tn.gov.in/judis
3.Pending investigation, the parties have entered into a compromise and joint compromise has been filed by the parties, wherein the defacto complainant has agreed to the dropping of the criminal proceedings in entirety and has no objection to quashing the FIR. 4.Today the defacto complainant is present in-person and he acknowledges the fact that he had agreed for quashing of the F.I.R.
5. Considering the above said facts, F.I.R. in crime No.484 of 2014, on the file of the first respondent police is hereby quashed against the petitioner alone. 6. Accordingly, this Criminal Original Petition stands allowed. The joint compromise memo shall form part and parcel of the order.
