1. Petitioner has filed this contempt petition alleging willful disobedience of the judgment dated 20.9.2022 passed in FA (Mat) No.25/2022, stating that the direction issued in Para-17 of the judgment under contempt is not being complied with.
2. Learned counsel for respondents No.2 and 3 would submit that they were not parties to FA (Mat.) No.25/2022 nor any direction was issued in specific terms to them and they have been erroneously arrayed as party respondents. He also pointed out that in the judgment, which is subject matter of this contempt petition, there is specific mention in Para-20 that decree be drawn-up accordingly.

Learned counsel for the petitioner submits that judgment, subject matter of contempt petition, is put to challenge by respondent No.1 herein before the Hon’ble Supreme Court by filing Special Leave to Appeal (C) No.23849/2022, which came to be dismissed vide order dated 16.2.2026. Thereafter, petitioner herein filed a contempt petition bearing No.304/2026 before Hon’ble Supreme Court in which notice is issued to contemnor and the matter is fixed for hearing on
15.7.2026.

4. Considering the fact that the judgment, which is subject matter of this contempt petition, is passed in civil proceeding in which decree has been ordered to be drawn, which is executable and further considering that a contempt petition filed by petitioner herein claiming same relief is pending
consideration before the Hon’ble Supreme Court, I am not inclined to continue with this contempt petition.
5. Consequently, this contempt proceeding is dropped and contempt notice stands discharged. The contempt petition is closed.
